KATHMANDU: Four leaders who left the UCPN (Maoist) center and joined the UML have filed a writ petition in the Supreme Court seeking reinstatement of their parliamentary seats. UML standing committee members Top Bahadur Rayamajhi and Lekhraj Bhatt, central members Prabhu Sah and Gauri Shankar Chaudhary have gone to court claiming that they are still with the Maoists.

Leader Rayamajhi has argued that they have not left the Maoists legally. "We did not say we had left the Maoists. The CPN (Maoist) and UML formed the CPN (Maoist). We are in the continuity of the CPN. The court dismissed the CPN (Maoist). In essence, we are in the CPN (Maoist), "he told Kantipur." Another thing is that we have become the CPN (Maoist) from a Maoist background. Prachanda also became a CPN member from a Maoist background. According to Rayamajhi, not only Pushpa Kamal Dahal but all the Maoists are waging 'people's war'. "Not only Prachanda, Baburam Bhattarai, Mohan Vaidya, Netra Bikram Chand, and Ram Bahadur Thapa are all Maoists," he said.

According to Rayamajhi, it doesn't matter where and in which party they are in public. 'When a case is fought, the court looks at it from a legal point of view. Legally, our name is in the Election Commission on behalf of the Maoists. The commission has not removed our name from the list of Maoists, 'he said. Leaders say that they have to go to court as they are neither UML nor Maoists. "The Supreme Court has said that there is a difference between you and the UML. On the other hand, the Election Commission knows only the Central Committee of the Ninth National General Convention of the CPN-UML and does not know others, 'said Rayamajhi. Rayamajhi, Bhatt, and Chaudhary have filed a writ petition in the Supreme Court. According to court sources, Sah filed the writ petition with a slightly different attitude.

UML central office secretary Sher Bahadur Tamang, on the other hand, said that the UML-affiliated leader was in the central committee. He said that the details would be sent to the Election Commission for updating soon. 'They have no hesitation in the UML. Even in difficult times, the comrades who said that they would leave all their posts and become UML should not think in any other way, 'he said. You are in charge. ' He said that the four leaders who went to the top should be tested. Rayamajhi's writ petition said, "Since I have not done anything that is considered to have been done by a political party, no precedent of the legal system regarding political party abandonment can be drawn against me." Sah, on the other hand, argued that his post would not be vacated by any one party as he was elected by the voters of both the UML and the Maoists. He went to the people with a joint manifesto of UML and UCPN (M) and demanded to be reinstated, arguing that the action taken by UCPN (M) was invalid.

Stating that there is no confirmation from anywhere that he has accepted the UML central committee member, he has demanded to reverse the action taken by UCPN (M) chairman Dahal. The leaders have argued that they were not asked for an explanation, were not given a chance to defend themselves, and that it was the Maoist Central Committee that asked for an explanation. All four leaders claim that the Central Committee of the UCPN (M) is illegal. He had earlier gone to the Election Commission to cancel the registration of the Maoist Center. The commission had rejected his application.

Dahal, the leader of the Maoist parliamentary party, had written a letter to the General Secretary of the Federal Parliament on March 7, 2008, informing that the party had taken action against four lawmakers and left the party. Two days later, the speaker announced that his post was vacant. Spokesperson of the Supreme Court Baburam Dahal has informed that the case of four persons has been fixed for Thursday.
