Supreme Court refuses to reinstate expelled Gandaki MP Thapa


Kathmandu. The Supreme Court has refused to issue an interim order to reinstate Krishna Thapa, a Gandaki state assembly member. On Wednesday, Justices Ishwar Prasad Khatiwada and Manoj Kumar Sharma refused to issue an interim order to stop the implementation of the decision to dismiss Thapa.

It is seen that the petitioner Thapa has been removed from the post on the basis of legal provisions related to defection including Articles 28, 32, and 34 of the Political Parties Act 2073 by giving him a chance to be heard and other legal issues raised by the petitioner should be resolved in a full hearing. Thapa was expelled by his party, the Rashtriya Janamorcha, for refusing to support the Nepali Congress-led coalition during the formation of a new government in Gandaki. He has lost the state assembly seat after being expelled from the party.

In its writ petition, the apex court has refused to issue an interim order.
